INMATE TRANSFERS

Assistance offered to Federal and State inmates in reviewing, developing and presenting their cases to appropriate officials for transfer consideration. Aid based on the expert knowledge of transfer criteria and procedures, and the ability to present the case in a posture that frequently offsets the standard reasons for denial.


INITIAL PRISON PLACEMENT

It is exceedingly important an inmate obtains the prison security level and location he desires at initial confinement. Current Bureau of Prisons (BOP) policy requires an offender to remain at the initial designated institution for a minimum of 18 months before being approved for a nearer to release prison transfer. This consulting service offers help in calculating a prisoner's classification score and determines the type of institution for which the inmate qualifies. Additionally, a particular geographic location in the United States may be requested on the prisoner's behalf, depending on the inmate's security level and availability of institutions in the desired area. Time is of the essence, as the BOP must be contacted, in writing, with an appropriate request based on current policy immediately after sentencing.


PAROLE HEARINGS REPRESENTATION

Experienced in calculating Federal Parole Guidelines and "coaching" Federal and State inmates in the hearing process. Develops and presents parole plans and presents arguments for parole based on criteria specific to paroling agencies. Well-versed in the criteria for appeals and effective methods for presenting the information.

Note: While Harvey R. Cox has successfully represented numerous Federal inmates before the United States Parole Commission, he does not represent Texas State inmates before the Texas Parole Board. However, he can provide referral to an appropriate attorney specializing in this activity.


ADMINISTRATIVE REMEDIES

Aids Federal and State inmates in developing, composing and presenting administrative remedies (grievances) on all types of prison matters with effective anticipation of Warden's response (based on personal experience) and counteracts within inmate's written complaint.


FEDERAL PRESENTENCE REPORT REVIEW

The content of the Federal Presentence Report (PSR) will determine many critical areas in an inmate's Federal confinement. It affects the type of institution he will be confined in, and the types of programs available. The PSR content may even preclude an inmate from important programs that could result in a reduction of sentence. A person familiar with Federal prison programs and how eligibility for the same is tied to those critical contents is essential for reviewing the PSR at the initial sentencing stage where the United States Probation Officer may be amenable to making changes to the document. Should the Probation Officer not make the suggested changes, he/she may allow the attorney to make a presentation to the Federal Judge for said changes, and the Judge will have the final ruling as to whether they will be allowed.

This consulting service offers full review of the draft PSR with written recommendations on any necessary changes as it pertains to Bureau of Prisons confinement and programs.


EXPERT WITNESS TESTIMONY

Frequently, inmates are involved in court matters that relate to their confinement. Depending on the specific issue, Harvey R. Cox can generally give a written notarized statement, based on his experience and education, that will be accepted in court as "expert testimony." Additionally, an appearance in court can be arranged if appropriate.
