INMATE TRANSFERS:
An inmate incarcerated in a
Federal prison near Dallas, Texas requested a transfer to a Camp near his home
in San Antonio. After making a written presentation to the Warden, the inmate
was granted his desired transfer to the facility near his family.
Testimonial:
"Dear Mr. Cox:
I just
wanted to let you know that on May 14, 1999, _______ was given a furlough
transfer via Greyhound to the Three Rivers Camp. We are both very happy. _______
said the atmosphere in the camp is so much more relaxed. This move has a
positive effect on _______. Sunday we were able to take one of his grandmothers
by to visit him. We both want to thank you for your help with the transfer."
INITIAL PRISON PLACEMENT:
The client was
sentenced to a Federal Prison in Texas; however, he had lived most of his life
in California. He had minimal prior criminal history and wanted a bootcamp close to
home. Written contact was made on the prisoner's behalf with the Federal Bureau
of Prisons Designations Administrator. The client was subsequently placed in a
bootcamp in California near his home.
Testimonial:
"Harvey, _______ learned
today that the Bureau of Prisons designated him to the bootcamp at the Lompoc
Federal Correctional Institution. I wanted to let you know and thank you for all
your thoughtful advice and assistance.
Signed, Attorney."
PAROLE HEARINGS REPRESENTATION:
The Federal
inmate, although convicted of major drug trafficking and organization, was given
parole within four months of his first hearing. His case was well-presented in
terms of accountability, prison adjustment, programs participation and release
plans.
Testimonial:
"Dear Mr. Cox:
It is my
intent to write and thank you on the parole decision. I am still overwhelmed
with joy. Yes, I have been recommending your name to other inmates who may need
your service."
ADMINISTRATIVE REMEDIES:
A Texas inmate
received a disciplinary report that contained several errors and was denied
relief through the structured grievance system. The Warden was contacted with a
written justification (failure to follow established procedures) requesting the
incident report be expunged from the inmate's record. The Warden concurred, and
the incident was stricken from the inmate's record.
FEDERAL PRESENTENCE REPORT REVIEW:
The client
was interested in participating in the Bureau of Prisons Residential Drug
Treatment Program which requires a documented abuse of drugs or alcohol.
Although the client had abused alcohol, it was not reflected in his Presentence
Report draft. After bringing this to the client's attention, his attorney was
able to add alcohol abuse to the PSR, thus allowing the inmate to meet the basic
qualification for this program.
EXPERT WITNESS TESTIMONY:
Expert witness testimonies have been given in 13 cases. These included testimonies for both the Prosecution and the Defense on matters involving prison issues, such as security, assaults, and classification.
